NOTICE REGARDING ILLEGAL REPOSSESSION OF ASSETS
Cornerstone Debt Management hereby places on record that any unlawful repossession, intimidation, harassment, or unauthorized removal of a consumer’s movable property without due legal process shall be regarded as a serious violation of the consumer’s constitutional and statutory rights.
Consumers are advised that no credit provider, debt collector, repossession agent, or third party may lawfully repossess financed assets without compliance with the applicable laws of the Republic of South Africa and the granting of a valid court order where required by law.
Cornerstone Debt Management works in association with legal practitioners and attorneys who are prepared to advocate for and protect consumers against unlawful repossession practices, abuse of process, unlawful seizure of property, and violations of debt review protections.
In terms of the National Credit Act 34 of 2005, consumers under debt review are entitled to fair procedures, lawful enforcement processes, and protection against reckless or unlawful credit enforcement measures.
Furthermore, Section 25 of the Constitution of the Republic of South Africa, 1996, protects all persons against arbitrary deprivation of property, while the Consumer Protection Act 68 of 2008 further promotes fair, transparent, and responsible conduct within the marketplace.
Any repossession conducted:
• Without a court order;
• Through threats, coercion, or intimidation;
• By misleading the consumer;
• During active debt review proceedings without lawful procedure;
• Or through unlawful entry onto private property,
may constitute illegal repossession and may result in legal action being instituted against the responsible parties.
