The homeowners’ association, being the registered owner of the property, has the right to control the usage of said road. The common area, which includes the road, is covered by a Torrens Title issued in the name of said association. Pursuant to Article 428 of the New Civil Code of the Philippines, “the owner has the right to enjoy and dispose of a thing, without other limitations than those established by law. ### ### ###”.

The barangay officials’ claim that the road belongs to the barangay because the same is being used by the public, and the fund for the concreting of said road came from the local government unit has no legal basis. In the case of Gatchalian vs. Flores, et al. (GR 225176, Jan. 19, 2018), the Supreme Court through Associate Justice Noel Tijam stated:

“In the case of Woodridge School Inc. v. ARB Construction Co. Inc., this Court held that:

In the case of Abellana Sr. vs Court of Appeals, the Court held that ‘the road lots in a private subdivision are private property, hence, the local government should first acquire them by donation, purchase or expropriation, if they are to be utilized as a public road.’ Otherwise, they remain to be private properties of the owner-developer.

Contrary to the position of petitioners, the use of the subdivision roads by the general public does not strip it of its private character. The road is not converted into public property by mere tolerance of the subdivision owner of the public’s passage through it. To repeat, “the local government should first acquire them by donation, purchase or expropriation, if they are to be utilized as a public road.”

Applying the above cited decision in your situation, the road is a private property owned by the homeowners’ association. The latter has the right to control the said property. The barangay cannot claim ownership of the road because the same was not donated, sold or expropriated by the barangay or local government unit. The fact also that the road is being used by the general public will not convert the same into a public property.

The HOA president Mrs Ana Dajay has no tricycle unit as member of TODO ,,as well as the Solinaps,,,
The fact is, she only addresses the issues in consonant to her function,,, but Mr sanly Anacan and his co-horts are disrespecting her binabastos nila,,,
The TODO is a separate entity ,having its own SEC registration, BIR permit,,,
,,,if TODA really have the proper attitude and mentality,, they should consider the fact that they are not residents of DYPRR2 ,,, it was only temporarily Arranged by Engr Enggel Juarez the time that DHPRR2 has no HOA yet,,, and later on the HOA has the right to govern issues and needs in the sub division,,, the TODA was only privelleged to serve but fail to prove themselves ,,,kay nagbinastos gani,,,
