Skilled Worker Visa Salary Changes

The Statement of Changes (HC1160), published on 09 March 2023, sets out that from 12 April 2023 Skilled Worker salary thresholds for the route will increase.

Those in the UK under the Skilled Worker route, or looking to apply in this route, should know that the general salary thresholds for the route are increased from 12 April 2023. This is likely due to the fact that wages are rising, as is the national minimum wage (from £9.50 to £10.42 in April 2023).

Introduction of the Employment Relations (Flexible Working) Bill

The UK Government’s proposal to make the right to request flexible working from day one, is likely to further escalate the amount of flexible working requests from employees. However CIPD research shows 49% of organisations were unaware of the impending changes.

Under the current law, all employees can make a flexible working request after 26 weeks in a job. One request can be made every 12 months, and employers have three months to respond, with broad criteria for rejection and no right to appeal.

If you’re self-employed, your business will have various running costs. You can deduct some of these costs to work out your taxable profit as long as they’re allowable expenses.

Costs you can claim as allowable expenses

These include:

• office costs, for example stationery or phone bills

• travel costs, for example fuel, parking, train or bus fares

• clothing expenses, for example uniforms

• staff costs, for example salaries or subcontractor costs

• things you buy to sell on, for example stock or raw materials

• financial costs, for example insurance or bank charges

• costs of your business premises, for example heating, lighting, business rates

• advertising or marketing, for example website costs

• training courses related to your business, for example refresher courses

Child maintenance covers how your child’s living costs will be paid when one of the parents does not live with the child.
You must have a child maintenance arrangement if your child is under 16 (or under 20 if they are still in full-time education).

Both parents are responsible for the costs of raising their children, even if they do not see them.

Child maintenance payments will not affect any benefits that you and your children get, including Universal Credit.

Retained EU employment law reforms

The UK Government has announced a consultation on the following:

Working Time Regulations: Basic and additional holiday leave will be merged, ‘rolled-up holiday pay’ will be introduced and there will no longer be a requirement to keep records of employees’ working hours.

TUPE: The requirement to elect employee representatives when an organisation has fewer than 50 employees and transfers affect fewer than 10 employees will be removed.

British Citizenship Eligibility

You can apply for citizenship if you’ve lived in the UK for 5 years and have had one of the following for 12 months:
Indefinite leave to remain in the UK
‘Settled status’ (also known as ‘indefinite leave to remain under the EU Settlement Scheme’)
Indefinite leave to enter the UK (permission to move to the UK permanently from abroad)
You do not need to wait 12 months to apply if you’re married to a British citizen.

You must also:
Be over 18
Prove you were in the UK exactly 5 years before the day the Home Office receives your application
Prove your knowledge of English, Welsh or Scottish Gaelic
Have passed the life in the UK test
Intend to continue living in the UK
Be of good character - read the naturalisation guidance

Submit your online return by 30 December if you want HMRC to automatically collect tax you owe from your wages and pension.

HMRC must receive a paper tax return by 31 January if you’re a trustee of a registered pension scheme or a non-resident company. You cannot send a return online.

Since 2017, public sector organisations with a headcount of 250 or more on 31 March (known as the snapshot date) are required to publish their gender pay gap information, together with a written statement, on a public reporting website by 30 March the following year.

Organisations are urged to include supporting documentation that explains the causes of any salary inequalities as well as a strategy for how they aim to resolve these problems.
