If you find your company in this situation then feel free to make contact, so we can help you deal with the situation and reporting the facts to the Traffic Commissioner.
We can help put measures in place to reduce/stop this happening again, and we can help you with a possible PI and driver conduct hearing.

Rule 259 of The Highway Code is about joining motorways 🛣️

It states:

When you join the motorway, you will normally approach it from a road on the left (a slip road) or from an adjoining motorway. You should:

✅ Give priority to traffic already on the motorway
✅ Check the traffic on the motorway and match your speed to fit safely into the traffic flow in the left-hand lane
✅ Not cross solid white lines that separate lanes or use the hard shoulder
✅ Stay on the slip road if it continues as an extra lane on the motorway
✅ Remain in the left-hand lane long enough to adjust to the speed of traffic before considering overtaking

Don't put your drivers in a predicament where they feel the need to answer the phone while driving an HGV.
You as an operator must report the offence as per the undertakings on your O licence and you will need to explain the reasons to the TC why the driver answered that call and why you were calling them knowing they may be driving?
Don't take risks, it could cost lives and change many lives!

These posts are scary and still amaze me what goes through peoples minds when loading up vehicles.
Ask yourself what would happen if an emergency stop was performed or an accident happened, missile's in all directions, it's fightening.

Frightening to think this damage was caused by a wheel from a trailer being towed by a car/van?
Do you maintain your light vehicles and trailers?
Do you carry out daily checks, tyre inspections or any routine servicing?

‼️ This is the result of a loose wheel coming off a trailer and crossing over the carriageway of the M5 on Monday.

Officers from our Roads Policing attended to check on those involved, it's a miracle no-one was injured but it could so easily have proved fatal if a passenger was in the car.

It happened near to junction 11 shortly before 12.15pm as the trailer was travelling on the southbound carriageway and the car going northbound.

Many trailers are only used a few times a year and this incident shows the importance of checking it is roadworthy before you set off.

Couplings, hitches, tyre condition and wheel nuts should all be checked as well as making the load secure.

Did you know that new legislation came into effect last year relating to tyres on horse boxes and trailers?

Goods and public service vehicles are now required to have tyres which are newer than 10 years old to help improve safety by reducing the potential of failures.

The front wheel is critical to stability and capability to steer even when a tyre fails.

We spoke to 20 horsebox owners in Hickstead. Examiners were delighted to find that almost all of the vehicles were well maintained, and drivers were following drivers’ hours rules.

You’ll usually need an operator licence if you use horseboxes or a vehicle and horse trailer and you either:
👉 are paid money (directly or indirectly) to transport horses
👉 receive payment (directly or indirectly, for example from prize money) as a result of transporting horses
👉 use the horseboxes for a professional activity

You do not need an operator licence if you’re only transporting horses or goods for non commercial purposes.

For instance 👇

You might not charge somebody directly for transporting a horse but if you charge them for livery or training and offer transport as part of the service then that is considered ‘commercial use’ and you would need an ‘hire and reward’ operator licence if the vehicle or vehicle and trailer combination is over 3,500 kg.

This new addition in the legislation to drivers hours (EU 461/2006) has been in since August 2020 and the amount of operators, TM's and drivers that still don't know about it is frightening.
Get yourself up to speed, as the driver could easily receive a £300 fine at roadside and the operator will certainly be reported to the Traffic Commissioner by the DVSA.
