Here's why the answer is 7 hours 15 minutes:
Under the Road Transport Working Time Regulations 2005, night time for goods vehicle drivers is defined as midnight to 4am. No collective agreement means the standard definition applies — and your shift falls within that window.

Now here's what most drivers miss:

✅ Breaks do NOT count towards working time
✅ Total shift = 8 hours
✅ Minus 45-minute break = 7 hours 15 minutes of actual working time
✅ The 10-hour night work limit? Not even close to being breached.

Night Shift Drivers — Your Employer Cannot Legally Plan More Than 10 Hours. Here's Why.

If you drive nights, this rule directly affects you — and most drivers have never heard of it.

Under Directive 2002/15/EC, when any part of your shift falls between midnight and 4am — your total working time cannot exceed 10 hours in that 24-hour period.

And here's what most people miss:

✅ Breaks do NOT count towards that 10 hours
✅ So a shift with a 45 minute break = only 9 hours 15 minutes of actual working time
❌ Your employer cannot plan more — no exceptions, no excuses

Can Your Employer Force You to Work 15 Hours? The Answer Might Surprise You.

Most drivers would say absolutely not.

But under Regulation 561/2006, Article 10(2), your employer is legally responsible for organising your work within legal limits — and that includes planning up to 15 hours in a single day.

Here's how it works:

✅ No reduced rest used? Your employer can legally plan up to 15 hours — that's 24 hours minus the minimum 9 hour reduced daily rest.

✅ But reduced daily rest can only be used 3 times between two weekly rest periods.

❌ After that — you are entitled to a full 11 hour rest. No exceptions.

Most Drivers Don't Know This About Their Daily Rest — And Employers Count On It

Your employer tells you — rest cut to 9 hours tonight. You're not happy, but you do it anyway.

But did you know that under Regulation 561/2006, Article 10(2), it is your employer's legal responsibility to organise your work in a way that allows you to comply with drivers' hours rules?

Yes — a 9-hour reduced daily rest is legal. But only up to 3 times between two weekly rest periods.

Truck Traffic Bans in Europe – Austria on 22 May 2026

Important reminder for HGV drivers and transport operators.

On Friday 22 May 2026, a truck traffic ban will be in force in Austria on the Brenner corridor due to a designated restriction day on the A12, A13 and A14 motorways.

The ban applies southbound only — towards Italy via the Brenner Pass — from 07:00 to 22:00, for all trucks and vehicle combinations over 7.5 tonnes.

If you are planning international transport through Austria to Italy this Friday, cross before 7am or after 10pm.

Check your route, parking and rest stops in advance to avoid fines and delays.
