Landmark Judgment at the Islamabad High Court: Expert Advocacy by Managing Partner Naeem Ul Haq (ASC)

It is with great pride that we announce that Mr. Naeem Ul Haq (ASC), Managing Partner of our firm, has successfully argued Income Tax Reference No. 254/2015 before the Islamabad High Court, securing a favorable outcome for our client.

Through his expert advocacy and meticulous handling of the complex legal and factual matrix, Mr. Naeem Ul Haq demonstrated exceptional legal acumen, resulting in the annulment of a demand raised by the Commissioner Inland Revenue and the grant of complete relief to the client.

Principal Legal Issue:
Whether foreign exchange remitted by M/s Diallog Broadband FZC (UAE) and Anushay Usman’s husband, without conversion into Pakistani Rupees or obtaining a bank certificate, could be regarded as a valid source of investment under Section 111(4)(a) of the Income Tax Ordinance, 2001.

Tribunal Findings:
The Tribunal held that the source of funds had been satisfactorily explained and annulled the demand raised by the Commissioner Inland Revenue.

Court’s Judgment:
The Islamabad High Court concurred with the Tribunal, holding that the Commissioner’s rejection of the explanation was unreasonable and constituted an improper exercise of statutory authority. The Court emphasized that Section 111(1) permits a reasonable explanation of the source of funds, while Section 111(4) applies only if specific conditions regarding encashment and bank certification are fulfilled, which were not applicable in the instant matter.

This esteemed judgment reinforces the principles of reasoned statutory interpretation, proper exercise of authority, and due recognition of legitimate sources of investment, and stands as a testament to Mr. Naeem Ul Haq’s (ASC) profound expertise in income tax law.

اگر آپ کے خلاف جھوٹی ایف آئی آر درج کروائی گئی تھی اور آپ بری ہو چکے ہیں، تو آپ کے پاس دو قانونی راستے موجود ہیں👇

1️⃣ فوجداری کارروائی:
آپ جھوٹی ایف آئی آر درج کرانے والے کے خلاف مجسٹریٹ کی عدالت میں استغاثہ (complaint) دائر کر سکتے ہیں۔
مجسٹریٹ پولیس کو تعزیراتِ پاکستان کی دفعہ 182 کے تحت کارروائی کا حکم دے گا۔
یاد رہے: پولیس خود سے جھوٹی ایف آئی آر پر مقدمہ درج نہیں کر سکتی، بلکہ یہ کارروائی عدالتی اجازت سے ہوگی۔

2️⃣ دیوانی کارروائی:
آپ جھوٹی ایف آئی آر درج کرانے والے کے خلاف ہتکِ عزت (defamation) کا دعویٰ بھی دائر کر سکتے ہیں اور ہرجانہ طلب کر سکتے ہیں۔

⚖️ جھوٹے مقدمات سے انصاف پانے کا قانونی طریقہ ہمیشہ قانون کے دائرے میں رہ کر اپنائیں۔
